Mortgage Modification Program (MMP)

The United States Bankruptcy Court for the District of Columbia has established the Mortgage Modification Program (MMP). These forms and procedures implement the program. The MMP is designed to function as a forum for individuals to explore mortgage modification options with their lenders for real property in which the debtors have an interest or are obligated on the promissory note or mortgage. The goal of the MMP is to facilitate communication and exchange of information in a confidential setting and encourage the parties to finalize a feasible and beneficial agreement with the assistance and supervision of the United States Bankruptcy Court for the District of Columbia.

Options

Mortgage modification mediation options include modification of a mortgage or surrender of real property owned by an individual debtor(s). Individuals who seek to modify a mortgage must have paid their bankruptcy filing fee in full prior to filing a motion to participate in the MMP.

Exchange of Information

In an effort to expedite the exchange of information between the debtor and the lender, the Court has mandated the use of a secure online portal (“MMP Portal”) and an on-line program that facilitates the preparation of the debtor’s loan modification package (“Document Preparation”). The use of a portal and documentation preparation software eliminates the need for multiple submissions of documents and unnecessary delay based upon incomplete documentation.
